1. Identity and scope
These terms and conditions apply to all services offered by AgDrones via agdrones.be. By submitting a request or confirming an assignment, you accept these terms. Deviations are only valid if agreed in writing.
2. Our services
AgDrones provides professional drone services performed by certified and insured pilots, in accordance with applicable Belgian and European aviation regulations (EASA). Our services include, among others, inspections (roof, facade, solar panels), real estate photography, event coverage and optional reports. The exact scope is described in the quote or confirmation.
3. Request, quote and formation of the contract
A request via our website, configurator, email, phone or WhatsApp is non-binding and does not constitute a binding agreement. After reviewing your request, you will receive a quote or confirmation with price, scope, date and delivery terms. The contract is formed when you accept the quote in writing (email, confirmation link or payment of a deposit if requested). Via the customer portal you can download your imagery, reports and invoices after placing an order. Access is provided through a secure magic link. AgDrones reserves the right to decline requests without stating a reason.
4. Prices and payment
Prices on the website and in the configurator are indicative and may vary depending on location, scope, complexity, options and reporting. Prices shown to consumers (B2C) include 21% VAT; business quotes and invoices (B2B) show amounts exclusive of VAT unless otherwise stated. The final price is stated on the quote or invoice. Payment term: 30 days from the invoice date, unless otherwise agreed. Payment can be made via Mollie (online), bank transfer with structured communication (OGM), or via PEPPOL for registered B2B customers. In the event of late payment, interest and collection costs may be charged in accordance with the Act of 2 August 2002 on combating late payment in commercial transactions.
5. Planning, execution and weather
Shoots and flights depend on weather conditions, visibility, wind, safety and aviation regulations. AgDrones may reschedule a planned date in unsafe or unsuitable conditions, in consultation with the customer. The customer ensures timely access to the location and provides relevant information about obstacles, high-voltage lines, restrictions or permits on the site. AgDrones performs the assignment with professional care according to the agreed scope. Additional work outside the scope will be discussed in advance and invoiced separately.
6. Customer obligations
The customer guarantees that they are authorised to have the assignment carried out at the relevant location and that all necessary permissions from the owner, property manager or administrator have been obtained. The customer provides accurate contact and location details and is present or reachable on the agreed date, unless otherwise agreed. The customer indemnifies AgDrones against claims from third parties arising from failure to fulfil these obligations.
7. Intellectual property and usage rights
All raw images, videos, reports and other deliverables remain the property of AgDrones until full payment of the invoice. After payment, AgDrones grants the customer a non-exclusive right of use for the agreed purpose (e.g. internal inspection, insurance file, property presentation), unless otherwise specified in writing. Redistribution, resale or commercial reuse outside the agreed scope requires prior written consent. Attribution may be requested upon publication.
8. Inspection reports and advice
Inspection reports and findings based on drone imagery are indicative and intended to support further analysis by qualified professionals (roofers, structural engineers, installers, insurers). AgDrones does not provide structural stability studies, certifications or statutory inspections, unless expressly agreed otherwise. Decisions based on our reports remain the responsibility of the customer.
9. Cancellation and changes
Cancellation by the customer: • Within 48 hours after appointment confirmation: free cancellation or rescheduling via the link in your confirmation email or customer portal • After this 48-hour window: contact info@agdrones.be; AgDrones may charge up to 50% of the agreed price to cover preparation and reserved capacity • No-show without prior notice: the full price may be charged AgDrones may cancel in the event of force majeure or unsafe conditions. In that case, a new date will be proposed or the deposit paid will be refunded.
10. Liability and insurance
AgDrones holds the required third-party liability insurance and professional indemnity coverage for drone operations. AgDrones is only liable for direct damage resulting from a proven fault or negligence in the performance of the assignment. Total liability is limited to the invoice amount of the relevant assignment, except in cases of intent or gross negligence. AgDrones is not liable for indirect damage, consequential damage, loss of profit, data loss or decisions the customer makes based on delivered imagery or reports.
11. Force majeure
In the event of force majeure (including extreme weather, aviation restrictions, strikes, pandemics, power or network outages, or other circumstances beyond our reasonable control), our obligations are suspended for as long as the force majeure continues, without compensation. If the force majeure lasts longer than 30 days, both parties may terminate the agreement for the unperformed part.
12. Privacy and data protection
AgDrones processes personal data in accordance with our privacy policy at agdrones.be/privacy. By using our services, you confirm that you have read this policy.
13. Applicable law and disputes
Belgian law applies exclusively to these terms and all agreements with AgDrones. Disputes will preferably be resolved by mutual agreement. Failing agreement, only the courts of the judicial district of Antwerp shall have jurisdiction, without prejudice to the right of consumers to bring proceedings before the courts of their place of residence where such right cannot be excluded by law.
14. Final provisions
If any provision of these terms is declared invalid or unenforceable, the remaining provisions shall remain fully in force. Failure by AgDrones to exercise a right does not constitute a waiver of that right. The most recent version of these terms is always available at agdrones.be/voorwaarden.
